This Privacy Policy describes how WholEstate ("WholEstate," "we," "us") collects, uses, and shares information when you use our wholesale real estate automation platform (the "Service"). By using the Service you agree to the practices described here.
1. Information we collect
We collect the following categories of information:
- Account data — name, email, company, and billing details you provide when signing up.
- Property & lead data — county records, distressed-property lists, owner contact details, and skip-trace results you import or generate.
- Communications data — call recordings, transcripts, SMS, and email content processed through the Service's dialer and messaging tools.
- Usage data — log data, device and browser information, and analytics about how you use the Service.
2. How we use information
We use information to:
- Provide, operate, and improve the Service and its AI features;
- Perform skip-tracing, list stacking, and motivation scoring you request;
- Generate contracts and documents from the deal data you supply;
- Process payments and manage your subscription;
- Detect fraud, enforce our Terms, and comply with legal obligations.
3. AI processing
The Service uses AI models to draft communications, grade calls, score leads, and generate documents. Your data may be processed by these models solely to deliver features you invoke. We do not sell your data, and we do not use your customers' personal data to train third-party foundation models without your instruction.
4. Sharing & disclosure
We share information only with: (a) service providers who process data on our behalf (payment processors, cloud hosting, skip-trace data vendors, telephony providers) under confidentiality obligations; (b) parties you direct us to share with, such as cash buyers or title companies; and (c) authorities where required by law. We never sell your personal information.
5. Compliance responsibilities
You are responsible for your own compliance with the Telephone Consumer Protection Act (TCPA), Do-Not-Call registries, and applicable state and federal marketing laws when using our calling, SMS, and direct-mail tools. The Service provides compliance guardrails but does not constitute legal advice.
When AI Phone places or answers a call, the audio is processed by our voice AI subprocessors (speech-to-text, text-to-speech, and the underlying language model) solely to hold the conversation and, if you request it, log a transcript. Calls may be recorded; some states require all parties' consent before recording, and some states require the AI to disclose that the caller is speaking with an automated assistant. You control an outbound-disclosure setting for your account (default off) and an inbound-disclosure setting; turning the relevant one on causes the assistant to state that it is an AI and that the call may be recorded at the start of the call. You are responsible for enabling the correct setting for the states you call into — see Terms §5, AI phone calling.
6. Data retention & security
We retain your data for as long as your account is active and as needed to provide the Service. We apply encryption in transit and at rest, access controls, and regular security review. See our Security page for details.
7. Your rights
Depending on your jurisdiction, you may request access, correction, deletion, or export of your personal data, and you may object to certain processing. To exercise these rights, contact us at support@wholestateai.com.
8. Changes to this policy
We may update this policy from time to time. Material changes will be posted here with an updated date. Continued use of the Service after a change constitutes acceptance.
