These Terms of Service ("Terms") govern your access to and use of the WholEstate platform (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the security of your account credentials and for all activity under your account.
2. The 7-day free trial
New accounts may start a 7-day free trial. No charge is made during the trial. Unless you cancel before the trial ends, your subscription will begin and the plan fee will be billed to your payment method. You may cancel at any time from your account settings.
3. Subscriptions & billing
Paid plans are billed in advance on a monthly or annual basis according to the plan you select. Fees are non-refundable except where required by law. We may change plan pricing with prior notice; changes take effect at your next renewal.
4. Acceptable use
You agree not to use the Service to:
- Violate the TCPA, Do-Not-Call rules, CAN-SPAM, or any applicable telemarketing, privacy, or consumer-protection law;
- Contact individuals who have not consented where consent is legally required, or override DNC flags without documented consent;
- Send unlawful, fraudulent, harassing, or deceptive messages;
- Represent yourself as a licensed real-estate broker or agent where you are not licensed, or market physical property you do not have the legal right to market;
- Reverse-engineer, resell, or misuse the Service or its AI outputs.
You are solely responsible for the legality of your wholesaling, marketing, and contract-assignment activities.
5. Your content & data
You retain ownership of the property lists, lead data, and documents you upload or generate ("Your Content"). You grant WholEstate a limited license to process Your Content solely to provide the Service. You represent that you have the right to upload and process Your Content.
6. AI-generated documents
The Service generates contracts, assignment agreements, and related documents from templates and your inputs. These are provided as tools, not legal advice. You are responsible for reviewing every generated document and, where appropriate, having it reviewed by a licensed attorney or title professional before use.
7. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not guarantee any specific deal volume, assignment fee, or business outcome. Skip-trace and county data are sourced from third parties and may contain inaccuracies.
8. Limitation of liability
To the maximum extent permitted by law, WholEstate's total liability arising from the Service will not exceed the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Termination
You may cancel at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the Service ends; you may export Your Content for 30 days after termination.
